1. Introduction and Acceptance of Terms

These Terms of Service (the “Terms”) govern your access to and use of the services, facilities, website, booking systems, and related offerings provided by Maple Haven Wellness Studio (“Maple Haven Wellness Studio,” “we,” “us,” or “our”).

By booking, attending, purchasing, or otherwise using any service offered by Maple Haven Wellness Studio, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our services.

These Terms apply to all clients, visitors, participants, and users of our services, including but not limited to yoga classes, guided meditation sessions, massage therapy, aromatherapy treatments, wellness coaching, and sound bath experiences.

2. Scope of Services

Maple Haven Wellness Studio is a wellness studio located in Toronto, Ontario, Canada, offering the following services:

  • Yoga classes
  • Guided meditation sessions
  • Massage therapy
  • Aromatherapy treatments
  • Wellness coaching
  • Sound bath experiences

Service descriptions, schedules, pricing, availability, and practitioner assignments may change from time to time. We reserve the right to modify, suspend, or discontinue any service, class, or offering at our discretion, subject to applicable law.

Certain services may be provided by independent contractors, licensed professionals, or third-party practitioners. Where applicable, those individuals remain responsible for their own professional conduct and licensing requirements.

3. User Obligations and Responsibilities

By using our services, you agree to:

  • Provide accurate, current, and complete information when booking or registering.
  • Inform us of any medical condition, injury, pregnancy, allergy, sensitivity, or other circumstance that may affect your participation.
  • Follow all studio rules, safety instructions, and directions provided by staff or practitioners.
  • Use our facilities and services in a respectful manner and avoid disruptive, abusive, unlawful, or unsafe conduct.
  • Arrive on time for appointments and classes and comply with any check-in or attendance requirements.
  • Refrain from attending if you are ill, contagious, or otherwise unable to safely participate.
  • Ensure that any minors attending services are properly supervised and that parental or guardian consent is obtained where required.

You are solely responsible for determining whether our services are appropriate for your physical, mental, and emotional condition. You should consult a physician or other qualified health professional before participating if you have any concerns.

You agree not to use our services as a substitute for medical diagnosis, treatment, psychotherapy, or emergency care.

4. Payment Terms and Conditions

Fees for services, memberships, packages, workshops, and products are displayed at the time of booking or purchase, unless otherwise stated. All prices are in Canadian dollars unless expressly indicated otherwise.

  • Payment is due at the time of booking, purchase, or as otherwise specified.
  • We may require a valid payment method to secure reservations.
  • We reserve the right to change pricing at any time, subject to applicable law and any pre-existing written agreement.
  • Taxes, including applicable federal and provincial taxes, may be added where required by law.
  • If a payment is declined, reversed, or charged back, we may suspend or cancel the associated booking or account.

If you purchase a package, membership, or multi-session service, any specific terms relating to expiry, transferability, and usage limits will be disclosed at the time of purchase and will form part of your agreement with Maple Haven Wellness Studio.

5. Cancellation and Refund Policy

Cancellations and refunds are subject to the following general policy unless a different written policy is stated for a particular service, event, or promotion:

  • Class or appointment cancellations must be made within the timeframe specified at booking.
  • Late cancellations and no-shows may be charged in full or partially, at our discretion and as disclosed in advance.
  • Refunds, if available, will be issued in the original form of payment unless otherwise required by law.
  • Packages, memberships, special events, workshops, and promotional purchases may be non-refundable or subject to separate cancellation terms.
  • We may cancel or reschedule services due to low enrollment, practitioner unavailability, safety concerns, or other operational reasons. In such cases, we may offer a rescheduled session, credit, or refund, as appropriate.

Nothing in these Terms limits any non-waivable consumer rights under applicable Canadian or Ontario law.

6. Liability Limitations

To the fullest extent permitted by applicable law, Maple Haven Wellness Studio, its owners, directors, officers, employees, contractors, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of our services.

You acknowledge that participation in wellness activities, including yoga, meditation, massage therapy, aromatherapy, wellness coaching, and sound bath experiences, involves inherent risks, including but not limited to physical strain, allergic reactions, emotional discomfort, dizziness, or injury.

You voluntarily assume all risks associated with participation, except to the extent caused by our gross negligence, wilful misconduct, or any liability that cannot be excluded under applicable law.

Our total aggregate liability for any claim arising from or related to the services shall be limited to the amount paid by you for the specific service giving rise to the claim, except where prohibited by law.

Nothing in these Terms is intended to exclude or limit liability for death or personal injury caused by negligence where such exclusion or limitation is not permitted under applicable law.

7. Intellectual Property Rights

All content provided by Maple Haven Wellness Studio, including but not limited to text, logos, branding, class formats, audio recordings, videos, photographs, course materials, handouts, designs, and website content, is owned by or licensed to Maple Haven Wellness Studio and is protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, publicly display, create derivative works from, or exploit any of our intellectual property without our prior written consent, except as expressly permitted by law.

Any feedback, suggestions, or ideas you provide to us may be used by Maple Haven Wellness Studio without restriction or compensation, unless otherwise agreed in writing.

8. Data Protection and Privacy

Maple Haven Wellness Studio collects, uses, discloses, and stores personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and any applicable provincial privacy legislation.

We may collect personal information such as your name, contact details, booking history, payment information, health-related information you voluntarily provide, and communication preferences for the purposes of:

  • Providing and managing services;
  • Processing payments and bookings;
  • Communicating with you about appointments, schedules, and updates;

9. Force Majeure

Maple Haven Wellness Studio shall not be liable for any delay, interruption, cancellation, or failure to perform resulting from events beyond our reasonable control, including but not limited to acts of God, fire, flood, severe weather, epidemic or pandemic, public health emergency, labour disputes, power outages, internet or telecommunications failures, government orders, transportation disruptions, or other similar events.

In the event of force majeure, we may suspend or modify services, reschedule bookings, or provide credits or refunds where appropriate and required by law.

10. Changes to Terms

We may update or revise these Terms from time to time to reflect changes in our services, legal requirements, or business practices. The updated Terms will be posted with a revised effective date.

Your continued use of our services after the revised Terms are posted constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using our services.

11. Applicable Law and Jurisdiction

These Terms and any dispute arising out of or relating to them, your use of our services, or any transaction with Maple Haven Wellness Studio shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Subject to any mandatory consumer protection rights or other non-waivable legal rights, you agree that the courts located in Toronto, Ontario shall have exclusive jurisdiction over any dispute arising from or related to these Terms or our services.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

The failure of Maple Haven Wellness Studio to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision.
